Introduction: Easy Tours of India, Inc is sponsoring this contest. By participating in the Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules. Eligibility: Open only to individual Travel Agents and their full time employees that are based in the United States and Canada, with accreditation from IATA, ARC, or other similar organization (found acceptable by organizers). Subject to all federal, state, provincial and local laws and regulations. Odds of winning in this particular drawing depend on the number of eligible entries received for the drawing. Void where prohibited. Contest Sponsor: Easy Tours Of India, Inc. Prize Sponsor: Easy Tours Of India, Inc. Timing: The Contest begins at 12:01:00 a.m. Eastern Time ("ET"), December 5th, 2007, and ends at 5:00 p.m. ET, December 31st, 2008. The drawing will be held on 01/16/09 How to Enter: 1. Go to www.easytoursofindia.com and follow the links and instructions for entry. After you have submitted the required information, you will receive one (1) entry into the Contest. 2. Or you can fill out a written entry form for 1 entry. LIMIT: one (1) entry per qualified Travel Agent. All entries must be received by one of the methods described above during the Promotion Period. All entries become the exclusive property of Contest Sponsor, and none will be acknowledged or returned. For extra entries, book travel through Easy Tours of India. How to increase your chance of winning: Book a small group tour or custom travel arrangements (with a deposit) for multiple entries – * First Booking earns 5 entries. * Second Booking earns 10 entries. * Third Booking (and all ensuing bookings) earns 15 entries. Proof of submission will not be deemed to be proof of receipt by Contest Sponsor. Contest Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, which will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Drawings: Prize Drawing: The Prize Drawing will be conducted in accordance with these Official Rules on or about April 1st. Except where prohibited, potential winners must sign and return to Contest Sponsor, within ten (10) business days of being notified, an affidavit of eligibility and liability/publicity release in order to claim his/her prize. If a potential winner cannot be contacted within three days (72 hours) after the first attempt to contact him/her or if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, an alternate entrant will be selected in his/her place at random from among all eligible entries received. If a potential winner is a Canadian resident, he/she will be required to correctly answer a time-limited mathematical skill-testing question by mail or telephone in order to win the prize. Prize – Approximate Retail Value: $8000.00. One (1) Grand Prize will be awarded to a randomly selected eligible entrant. The prize for which an entrant is eligible for is a 10 Day First Visit Small Group Tour for two based on double occupancy at the Luxury Level. Winner will also receive all inclusions (including internal flights) as listed on our website and brochures, and also detailed below. International Airfares is not included. Winner has the option to upgrade to a longer Tour on the same dates and pay the difference. The small group our dates are subject to availability (120 days advance notice is required) and the winner will have the option to select between the following six departure dates: October 2nd, 2008 - October 23rd, 2008 - November 20th, 2008 - January 22nd, 2009 - March 12th, 2009 - April 9th, 2009 Prize Restrictions: Accommodations are subject to availability at the time of booking. Winner and Guest must be 18 years of age when Liability Release is executed. All Trip and prize details (including, but not limited to hotels, room, and/or transportation) will be designated solely by Sponsor, and may be changed without notice at any time based on Sponsor's sole discretion. Once booked, travel arrangements may not be changed. The Prize winner and his/her travelling companion will be responsible for all expenses not specifically stated as part of the Prize, including but not limited to, international travel, overnight accommodation prior to or following the travel dates in order to accommodate flight connections, income taxes, insurance, passport and visa costs, gratuities, most meals, beverages, incidentals and any items of a personal nature. Cancellation insurance is not part of the Prize, but is recommended. Winner is responsible for procuring adequate documentation for travel. Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part, for any destination. Any expenses not specified are the sole responsibility of the winner. At the sole discretion of Easy Tours of India, the prize value may be credited towards a different tour and/or a different Tour level, including custom tours Sponsor is not responsible for additional entertainment, taxes and any or all fees. Any cancellation will be assessed to the winner for all applicable cancellation fees associated with the hotel. No substitutions. Trip is not transferable or redeemable for cash. The winner is responsible for any expenses not expressly included in the prize description, such as international travel, personal ground transportation, in-flight entertainment, travel related taxes, income taxes, personal expenses, incidentals, expenses caused by flight interruption. This prize has no cash, redemption or barter value. No alternative prize, cash equivalent, or other substitution is permitted. Other restrictions and conditions of travel apply. Passports that are valid as per the Indian Governments requirements & the appropriate Visa will be required for travel. Winner is solely responsible for all federal, state, and local taxes and other fees emaciated with prize receipt and use. No other substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value. Publicity: Except where prohibited, participation in the Contest constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration. General Conditions: Contest Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Contest Sponsor's reasonable control impairs the integrity of the Contest, as determined by Contest Sponsor in its sole discretion. In such event, Contest Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Contest Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Contest Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Contest Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Release: By entering this Contest, entrant agrees to release and hold harmless, Easy Tours of India, Inc., as well as all their related companies, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize. Limitations of Liability: Contest Sponsor is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Contest; (iv) electronic or human error which may occur in the administration of the Contest or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sponsor Contest, or any prizes awarded, other than the administration of the Contest or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Texas State Court ; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
